By accessing or using our website and services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Merchandise Sales

Mother of Merch sells merchandise to businesses (B2B). Prices and availability of items are subject to change without notice. All orders are subject to acceptance and availability.

3. Payment Terms

Payments must be made in full at the time of order, unless otherwise agreed upon. We accept various payment methods including credit card, PayPal, and bank transfers. Invoices are sent after order has been discussed and confirmed by you and Mother of Merch if done via our discovery call. If you buy directly through our store, you will receive a receipt - but an invoice can be generated on request - please e-mail [email protected] together with your order number to request.

4. Shipping and Delivery

Mother of Merch is a UK based business. We aim to deliver merchandise within 5-10 working days. If you require an order to be sent out before this time, then please email us at [email protected] before placing an order. A standard fee of £50 will be incurred for rushed shipping. Shipping costs and times vary depending on location and the weight and size of the items ordered and will be disclosed at the time of purchase. Mother of Merch is not responsible for delays caused by external factors such as shipping carrier issues or customs delays. All items are sent out via RM tracked 48 unless otherwise specified.

5. Intellectual Property and Image Use

5.1 Content and branding on sites we manage

All content on our website, including text, graphics, logos, and images, is the property of Mother of Merch or our content suppliers and is protected by international copyright laws.

5.2 Customer submissions

By submitting images for use on any merchandise, you confirm that you have full permission and legal rights to use these images. We do not accept copyrighted images without proper authorisation, and it is your responsibility to ensure that no copyright violations occur. Mother of Merch holds no liability for any misuse of copyrighted materials submitted by customers.

5.3 Ownership of Designs and Assets

All content, designs, images of products taken and logos are owned by Mother of Merch or licensed for use. Customers must ensure they have the rights to any images or content they submit for personalised products.

6. Limitation of Liability

Mother of Merch will not be held liable for any damages arising from the use of our services, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

7. Ordering Process

Online orders can be placed via our website, or via email where an invoice will be generated for you. For event sales, products can be purchased directly in person. Once an order is placed, if you notice any mistakes then please contact us immediately - if the item has already been made/materials already sourced to make the order, your order cannot be modified or cancelled due to the personalised nature of our products. If you notice a mistake please email us at [email protected] and we will try to facilitate your request. If parts of the order have already been ordered, we can change any mistakes but there will be an additional charge which will be provided at the time.

8. Pricing and Payments

All prices are listed in GBP (British Pounds) and may vary based on location, applicable taxes, and shipping fees. Payments can be made via credit card, PayPal, bank transfer or in person at events. All B2B (business to business) transactions are final once confirmed.

9. Event Merchandise Sales

Mother of Merch offers an in person team to conduct sales at your events. Full details are provided within the terms of 'The Peak Experience' service.

10. Minimum Orders.

We do not have a minimum order quantity. The price of smaller orders will be higher due to the cost of individual materials and postage.

11. Returns and Damaged Goods

Due to the personalised nature of our products, we do not accept returns or offer refunds for change of mind. In the unlikely event that your merchandise arrives damaged or defective, please contact us at [email protected] within 5 working days of receipt with photographic evidence. We will assess the issue and, if appropriate, arrange a replacement or credit. Reports made after this period may not be eligible for replacement or credit.

12. 90 Minute Magnet Maker

The 90 Minute Magnet Maker must be paid in full at the time of booking to confirm your session. Cancellations or rescheduling can be made via the link provided or by emailing us at [email protected]

Cancellations with more than 7 days’ notice (before your scheduled appointment) and without a submitted consultation form are eligible for a full refund.

Cancellations with less than 7 days’ notice, but more than 24 hours notice, or after your initial form has been submitted, are eligible for a 50% refund, as preparatory work will have already commenced.

Cancellations with less than 24 hours notice are non-refundable.

Failure to attend your appointment without notice is non-refundable.

You may reschedule your call up to 48 hours before your scheduled appointment at no additional charge.

For rescheduling requests made with less than 48 hours notice, an additional fee may apply. Please email us at [email protected] for assistance with rescheduling.

13. 90 Minute Merch Maker

The 90 Minute Merch Maker must be paid in full at the time of booking to confirm your session. Cancellations or rescheduling can be made via the link provided or by emailing us at [email protected]

14. Discovery Calls

A fully refundable £10 fee is required at the time of booking your discovery call. If you attend and complete your discovery call, then the £10 will be either refunded to you or put towards the cost of any future services that you take out with Mother of Merch as a result of the Discovery Call. This decision will be given to you on the call.

Cancellations with more than 3 days' notice are eligible for a full refund.

Cancellations with less than 3 days' notice are non-refundable.

Failure to attend your appointment without notice is non-refundable and you will be charged an additional £40 - this fee will be charged to your card directly.

15. Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. Continued use of our services after changes are made constitutes acceptance of those changes.

16. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

17. Force Majeure

Mother of Merch will not be liable for any failure or delay in performing its obligations where such failure or delay results from causes beyond our reasonable control, including but not limited to natural disasters, strikes, supply chain disruptions, or governmental actions.
